CONVENTIONAL RULES OF PUBLIC MANAGEMENT AND ADMINISTRATION OF THE EU CUSTOMS SPHERE: IMPLEMENTATION IN UKRAINE

Abstract

The article describes the process of implementing norms in Ukraine, including EU convention norms in the field of public administration of customs affairs. The author analyzed the current state of implementation of convention norms in the domestic customs legislation. The article revealed the need to implement changes in the public administration of the customs sphere of Ukraine, in particular through the application of institutional, organizational, and functional changes. Ukraine has made significant progress in the implementation of the EU Customs Code, and has confirmed its readiness to further support Ukraine in this direction. Progress is the issue of acquisition by Ukrainian enterprises of the status of Authorized Economic Operator, accession of Ukraine to the Convention on the Common Transit Procedure and the Convention on the Simplification of Formalities in Trade in Goods. The years 2022–2023 have become the years of implementation of convention norms in the customs sphere of Ukraine.

The author states that the adoption of changes at the legislative level fulfilled one of Ukraine’s obligations stipulated by the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand. Participation in the Convention on the Simplification of Formalities in Trade in Goods allows you to fulfill the conditions for joining the common transit procedure, since joining this procedure is possible only in case of simultaneous joining the Convention on the Common Transit Procedure and the Convention on the Simplification of Formalities in Trade in Goods, and also applies the mechanism of mutual administrative assistance between the contracting parties to the Convention on the Simplification of Formalities in Trade in Goods to identify inconsistencies or violations in matters regulated by this Convention.

The article substantiates that the convention norms are only beginning to be implemented at the national level. After all, the next steps will concern small and medium-sized enterprises, trade and sustainable development, e-commerce and technical cooperation. Taking into account the presence of a number of European Conventions, the norms of which are planned for implementation, the sphere of public management of the customs sphere will undergo changes, in particular in terms of changes in the sanitary and phytosanitary sphere, simplification of trade procedures, protection of intellectual property, public procurement, etc.
