Abstract

The article analyzes the theoretical principles of the application of artificial intelligence in the public administration system as a basis for transparency. The basic principle of using artificial intelligence in public administration is transparency. On the one hand, it means clarity (the process of artificial intelligence and the result obtained by it), on the other hand, it includes the general availability of such an explanation to the general public. In this regard, it is necessary not only to establish a presumption of transparency of the use of artificial intelligence in public administration but also to establish by default the obligation of disclosure by state bodies of the purposes of using artificial intelligence (with the exception of those areas of public administration (for example, intelligence, defense, and security), where such disclosure may threaten the national security of the state). In this perspective, we can talk about the objective side of the transparency of the use of artificial intelligence in public administration. The transparency of the use of artificial intelligence in public administration implies the availability of open software code in contrast to the private sector, where its proprietary law prevails. In turn, the proprietary nature of the algorithm may not only lead to a violation of fundamental human rights and freedoms but also be an obstacle to the implementation of the principle of transparency of artificial intelligence. In this regard, it is necessary to achieve a balance, on the one hand, between transparency and intellectual property rights, given that we cannot exclude a situation in which the achievements of the private sector (including the developed software code) can find their application in the field of public administration; on the other - between transparency and the real possibility of its implementation, due to the complex technological component of artificial intelligence systems. Transparency is the most important aspect of quality public administration (reasonableness, effectiveness, efficiency), and in the context of digitalization and digital transformation of public administration, ensuring transparency in the use of artificial intelligence technology becomes critically important.
